Terms of Service & Policy Questions

What is Viva Studios' policy for booking and payment of the studio space?

At Viva Studios, all studio rental charges must be paid in advance at the time the reservation is made. Payments can be made via credit card or business check (no personal checks are accepted). The studio space is not considered reserved until both the payment and signed rental contract are received.

Renters must agree to pay the company’s studio rental pricing in effect at the time of reservation. The rental period, which includes set up, break-down, and clean up time, is prearranged at the time of booking. It is important to note that the studio must be cleaned and vacated by the end of the rental period. Any prior prep time or drop-off and pick-up of equipment, props, or other items after the shoot must be negotiated at the time of the rental contract, and additional fees may apply.

What are the cancellation charges for studio rentals at Viva Studios?

Viva Studios offers a tiered cancellation policy depending on the notice provided prior to the event start time:

  1. Bookings cancelled 14-30 or more days before the event start time will receive a full refund.
  2. Bookings canceled between 7 and 14 days before the event start time will receive a 50% refund.
  3. Bookings canceled within 7 days or less before the event start time are not refundable.

It is important to note that if Viva Studios must cancel your reservation due to reasons within their control, you will be given either rescheduling priority or a full refund. However, the company is not liable for any cancellations caused by factors outside their control, such as power outages, weather, acts of God, or emergencies. In such cases, a prorated refund or rescheduling priority will be offered depending on whether the rental period had started or not.

Does Viva Studios allow smoking, alcohol consumption, or pets on the premises?

Viva Studios prioritizes a clean and safe environment for all clients. Therefore, smoking is prohibited within the building and within 30ft of any entrance. Alcohol consumption is not allowed on site, and pets are only permitted with prior written consent from a Viva Studios representative.

What are the responsibilities of the renter regarding the conduct and welfare of their party at Viva Studios?

The renter at Viva Studios is solely responsible for the conduct and welfare of all individuals accompanying them while on the company premises. Renters must ensure that their party complies with the studio rules, which include, but are not limited to:

• No smoking in the building or within 30ft of any entrance • No consumption of alcoholic beverages on site
• Maintaining a reasonable sound level (the renter assumes legal and financial responsibility for noise violations during their rental)
• Notifying the studio about any animals being brought on site, which requires prior notice and approval
• Adhering to the prohibition of hazardous, illegal, or negligent practices, activities, or substances

A studio representative may, at their sole discretion, be present at all times. If any rules violations are observed, Viva Studios reserves the right to stop the shoot and may require the renter and their party to leave immediately without a refund for unused time. The renter assumes full responsibility for any legal infractions, damages, or injuries caused by themselves or their party during the booking.

How does Viva Studios handle liability and damages during a studio rental?

At Viva Studios, the use of the studio and equipment is at the renter’s own risk. Renters waive their rights to seek legal redress for any mishaps, accidents, or damages, whether direct or indirect, that may occur during their rental. Renters are solely responsible for any legal infractions, damages, or injuries caused by themselves or their party while on the premises.

In case of any damage to or loss of equipment or studio property caused by the renter or their party, the renter agrees to pay for the repair costs within 4 business days from the end of the rental period. Additionally, if the studio is not left in the condition it was found, a $100 cleaning fee will be charged.

Renters are responsible for the conduct and welfare of all persons accompanying them while on company premises, and they agree to indemnify and hold the company and its representatives harmless from any actions or claims that may arise from their conduct. This indemnification applies during and after the term of the rental and extends to any suit, claim, loss, accident, injury, or damages, including reasonable attorney’s fees.

What happens if the studio is not vacated by the end of the rental period at Viva Studios?

Renters are required to vacate the studio by the end of the prearranged rental period, which includes setup, breakdown, and clean-up time. A 15-minute grace period is provided, after which an overtime fee of $90 will be charged. Overtime fees will continue to accrue at a rate of $90 every 30 minutes thereafter. If you believe you will need more time for your production, please inform us at least 1 hour before your scheduled end time to be charged at the regular rate of $150 per hour, rather than the overtime rate.
